  1. Definition and Nature of Personal Data
    During your use of the Homecalm.fr website (hereinafter: the "Site"), we may ask you to provide us with personal data about yourself. The term "personal data" refers to all data that allows the identification of an individual, which specifically includes your name, first names, pseudonyms, photographs, postal and email addresses, telephone numbers, date of birth, data related to your transactions on the Site, details of your purchases and subscriptions, credit card numbers, as well as any other information you choose to communicate to us about yourself.

  2. Purpose of this Charter
    This charter aims to inform you about the means we implement to collect and process your personal data, in strict compliance with your rights. We hereby indicate that we comply, in the collection and management of your personal data, with Law No. 78-17 of January 6, 1978, relating to data processing, files, and freedoms, in its current version.

  3. Identity of the Data Collection and Processing Manager
    The person responsible for the collection and processing of your personal data is the company HOMECALM, SARL with a capital of 50,000 euros, registered in the Draguignan Trade and Companies Register under the number SIRET 97891799500018, having its registered office at 594 B chemin du riou blanc, 83440, Tourrettes (hereinafter referred to as "We").

  4. Collection and Processing of Personal Data
    Your personal data are collected and processed for one or more of the following purposes:

i. Manage your access to certain services available on the Site and their use,
ii. Perform operations relating to customer management concerning contracts, invoices, loyalty programs, customer relationship tracking,
iii. Create a file of registered members, users, customers, and prospects,
iv. Send newsletters, solicitations, and promotional messages. If you do not wish this, we give you the opportunity to express your refusal on this matter at the time of the collection of your data;
v. Develop commercial statistics and attendance figures for our services,
vi. Organize contests, lotteries, and all promotional operations excluding online gambling and games of chance subject to the approval of the Online Gaming Regulatory Authority,
vii. Manage the management of people's opinions on products, services, or content,
viii. Manage unpaid bills and possible disputes regarding the use of our products and services,
viiii. Comply with our legal and regulatory obligations.

We inform you, during the collection of your personal data, whether certain data must be mandatorily filled in or if they are optional. We also tell you what the possible consequences of not responding are.

  1. Recipients of Collected and Processed Data
    Only our company's staff, the control services (notably the statutory auditor), and our subcontractors will have access to your personal data. Public bodies, exclusively to meet our legal obligations, legal assistants, ministerial officers, and bodies responsible for debt collection may also be recipients of your personal data.

  2. Transfer of Personal Data
    Your personal data will not be subject to transfers, leases, or exchanges for the benefit of third parties.

  3. Duration of Personal Data Storage
    (i) Concerning data related to customer and prospect management: Your personal data will not be stored beyond the duration strictly necessary for the management of our commercial relationship with you. However, data used to establish proof of a right or contract, which must be stored as part of a legal obligation, will be stored for the duration provided by current law.
    Regarding possible prospecting operations towards customers, their data may be stored for a period of three (3) years from the end of the commercial relationship.
    Personal data relating to a non-customer prospect may be stored for a period of three (3) years from their collection or the last contact from the prospect.
    At the end of this three (3) year period, we may contact you again to find out if you wish to continue receiving commercial solicitations.
    (ii) Concerning identity documents: In case of exercise of the right of access or rectification, data relating to identity documents can be stored for the period provided for in Article 9 of the Code of Criminal Procedure, i.e., one year. In case of exercising the right of opposition, this data can be archived for the limitation period provided for by Article 8 of the Code of Criminal Procedure, i.e., three (3) years.
    (iii) Concerning data related to bank cards: Financial transactions relating to the payment of purchases and fees via the Site are entrusted to a payment service provider who ensures their smooth running and security.
    For the needs of the services, this payment service provider may have to be the recipient of your personal data relating to your credit card numbers, which it collects and stores on our behalf and on our account.
    We do not have access to this data.
    To allow you to make regular purchases or pay the related fees on the Site, your data related to your credit cards are stored for the time of your registration on the Site and at the very least, until you carry out your last transaction.
    By ticking the box expressly provided for this purpose on the Site, you give us your explicit consent for this storage.
    Data related to the visual cryptogram or CVV2, written on your credit card, are not stored.
    If you refuse that your personal data related to your credit card numbers be stored in the conditions specified above, we will not store these data beyond the time necessary to carry out the transaction.
    In any case, these data may be stored, for a proof purpose in case of possible dispute of the transaction, in intermediate archives, for the duration provided for in Article L 133-24 of the Monetary and Financial Code, namely thirteen (13) months following the debit date. This period may be extended to fifteen (15) months to take into account the possibility of using deferred debit payment cards.
    (iv) Concerning the management of lists of opposition to receiving prospecting: The information allowing to take into account your right of opposition is kept for at least three (3) years from the exercise of the right of opposition.
    (v) Concerning audience measurement statistics: The information stored in the users' terminal or any other element used to identify users and allow their traceability or attendance will not be kept beyond six (6) months.

  4. Security
    We inform you that we take all useful precautions, organizational and technical measures appropriate to preserve the security, integrity, and confidentiality of your personal data and, in particular, to prevent them from being distorted, damaged, or unauthorized third parties having access to them. We also use secure payment systems in accordance with the state of the art and applicable regulations.

  5. Cookies
    Cookies are text files, often encrypted, stored in your browser. They are created when a user's browser loads a given website: the site sends information to the browser, which then creates a text file. Each time the user returns to the same site, the browser retrieves this file and sends it to the website's server.
    There are two types of cookies, which do not have the same purposes: technical cookies and advertising cookies:
    Technical cookies are used throughout your navigation, to facilitate it and perform certain functions. A technical cookie can for example be used to remember the answers filled in a form or the user's preferences concerning the language or the presentation of a website, when such options are available.

    We use technical cookies. These are stored in your browser for a period of thirteen (13) months.
    We do not use advertising cookies. However, if we were to use them in the future, we would inform you beforehand and you would have the possibility, if necessary, to deactivate these cookies.
    We use Google Analytics, which is a statistical tool for analyzing audience that generates a cookie allowing to measure the number of visits to the Site, the number of pages viewed, and the activity of the visitors. Your IP address is also collected to determine the city from which you connect. The duration of conservation of this cookie is mentioned in Article 7 (v) of this charter.
    We remind you that it is possible to oppose the deposit of cookies by configuring your browser. Such a refusal could, however, prevent the proper functioning of the Site.

  6. Consent
    When you choose to communicate your personal data, you expressly give your consent for the collection and processing of these in accordance with what is stated in this charter and the prevailing legislation.

  7. Access to Your Personal Data
    In accordance with Law No. 78-17 of January 6, 1978, relating to data processing, files, and freedoms, you have the right to obtain communication and, where appropriate, rectification or deletion of data concerning you. You can also address:

    It is reminded that any person can, for legitimate reasons, oppose the processing of data concerning them.

  8. Modifications
    We reserve the right, at our sole discretion, to modify this charter, in whole or in part, at any time. These changes will come into effect from the publication of the new charter. Your use of the Site following the entry into force of these changes will be deemed recognition and acceptance of the new charter. Failing this, and if this new charter does not suit you, you should no longer access the Site.
